Who should rule? People should rule themselves, and those who are unable to do that threaten the lives, liberty and pursuit of happiness of those who can. The people who are able to rule themselves without infringing on the lives, liberty or pursuit of happiness of others can voluntarily join their inherent and unalienable rights of self-defense to organize protective institutions. (Cf. Bastiat’s The Law.) The Common Law, with its courts, did this. This is the purpose of government as articulated in the Declaration of Independence.
